Man shot after scuffle with deputy
A man was shot in the leg after he allegedly pointed a gun at a Wadena County sheriffs deputy.
Deputy David Shaw shot Gary Franklin Albin, 62, of rural Sebeka on Saturday.
The incident happened about 9:45 a.m. Saturday, when Shaw attempted to stop a vehicle driven by Albin, according to the sheriffs department. An arrest warrant had been issued for Albin for reckless driving, driving after revocation and no seat belt, Chief Deputy Steve Young said. Shaw was attempting to execute the warrant.
Shaw tried to stop Albin in his vehicle, but Albin failed to stop and drove to his home outside Sebeka, according to a Wadena County Sheriffs Department news release. Shaw pushed Albins vehicle into the ditch with his squad car and Albin ran into his house, came out with a firearm and came toward the deputy. After repeated warnings from Shaw to stop and put down the firearm, Albin pointed the firearm at the deputy, according to the sheriffs department.
Then, Shaw shot Albin, striking him in the leg. Albin was transported by ambulance to an area hospital. He was released Monday and is now held at the Wadena County Jail pending formal charges, Young said.
Shaw was placed on administrative leave pending the outcome of an investigation by the Minnesota Bureau of Criminal Apprehension. This is typical procedure after an officer is involved in a shooting.
Shaw is a part-time deputy for Wadena County Sheriffs Department and Wadena and Battle Lake police departments.
Young said he doesnt recall a time when a Wadena County deputy shot someone.
The Sebeka Police Department, Minnesota State Patrol, Minnesota Bureau of Criminal Apprehension and Tri-County Ambulance assisted the sheriffs department.
Albin has had incidents with law enforcement in the past.
According to court records:
" March 31, 1987, Albin fired at a squad car of a Sebeka police officer and hit the right front fender. He used a .25 caliber semi-automatic pistol. He was charged with second-degree assault and sentenced to 36 months in prison.
" Sept. 22, 1989, Albin was charged with possessing a .22 caliber Ruger single six revolver handgun after being convicted of second-degree assault. He was sentenced to 15 months in prison.
" Oct. 27, 1992, Albin sprayed a chemical agent into the eyes of a Sebeka police officer and was charged with third-degree assault, a felony. He was sentenced to 18 months in prison.
" Nov. 8, 2000, Albin was charged with fleeing a police officer in a motor vehicle, a felony, and driving under the influence of alcohol, a gross misdemeanor. He was sentenced to 15 months in prison.
" Aug. 7, 2002, Albin was charged with driving after revocation.
" Oct. 24, 2005, Albin was charged with reckless driving, driving after revocation and no seatbelt. These latest charges resulted in the arrest warrant that Shaw was attempting to execute.
