lien in the real estate described in the com-

plaint herein,

SUMMONS

THE STATE OF MINNESOTA TO THE

ABOVE NAMED DEFENDANTS:

You are hereby summoned and required

to serve upon Plaintiffs attorneys an Answer

to the Complaint which is on file in the office

of the Court Administrator of the above-

named Court, within twenty (20) days after

service of this Summons upon you, exclusive

of the day of service, except that the United

States of America shall have sixty (60) days

in which to serve its Answer to the Com-

plaint. If you fail to do so, judgment by de-

fault will be taken against you for the relief

demanded in the Complaint.

This action involves, affects, or brings into

question real property situated in the County

of Wadena, State of Minnesota, described as

follows:

LEGAL DESCRIPTION

That part of the NE% of Sec 7 and part of

the NW% of Sec 8, all in Twp 134, Rng I 35,

described as follows: Commencing at a

found iron monument which designates the

Northeasterly corner of Lot 1, Block 10 of the

Original Townsite of Wadena; thence North

27 degrees 40 minutes 17 seconds East on

an assumed bearing along the Northwesterly

line of First Street Southeast, for a distance

of 462.01 feet to a found iron monument on

the Northeasterly line of Aldrich Avenue;

thence South 62 degrees 15 minutes 42 sec-

onds East for a distance of 80.00 feet to the

Southeasterly line of said First Street South-

east, said point is the point of beginning;

thence continuing South 62 degrees 15 min-

utes 42 seconds East along said Northeast-

erly line of Aldrich Avenue for a distance of

67.72 feet to the West line of said Sec 8;

thence South 00 degrees 40 minutes 29 sec-

onds East along the West line of said Sec 8,

also being the Northeasterly line of Aldrich

Avenue, for a distance of 11.37 feet; thence

South 62 degrees 15 minutes 42 seconds

East continuing along said Northeasterly line

of Aldrich Avenue for a distance of 226.88

feet to a found iron monument; thence North

27 degrees 40 minutes 17 seconds East for

a distance of 129.65 feet; thence North 62

degrees 18 minutes 20 seconds West for a

distance of 300.00 feet to the Southeasterly

line of said First Street Southeast; thence

South 27 degrees 40 minutes 17 seconds

West along the Southeasterly line of said

First Street Southeast for a distance of

119.42 feet to the point of beginning. The

above described tract contains 38,156

square feet.

SUBJECT TO an easement for Railroad

purposes over, under and across part of the

above tract described as follows: Commenc-

ing at a found iron monument which desig-

nates the Northeasterly corner of Lot 1,

Block 10 of said Original Townsite of Wade-

na; thence North 27 degrees 40 minutes 17

seconds East along the

Northwesterly line of said First Street

Southeast, for a distance of 462.01 feet to a

found iron monument on the Northeasterly

line of Aldrich Avenue; thence South 62 de-

grees 15 minutes 42 seconds East for a dis-

tance of 380.00 feet to a found iron monu-

ment; thence North 27 degrees 40 minutes

17 seconds East for a distance of 102.65

feet to the point of beginning of the ease-

ment to be described; thence North 62 de-

grees 18 minutes 20 seconds West for a dis-

tance of 300.00 feet to the Southeasterly line

of said First Street Southeast; thence North

27 degrees 40 minutes 17 seconds East

along said Southeasterly line of First Street

Southeast for a distance of 17.00 feet;

thence South 62 degrees 18 minutes 20 sec-

onds East for a distance of 300.00 feet;

thence South 27 degrees 40 minutes 17 sec-

onds West for a distance of 17.00 feet to the

point of beginning of said Railroad ease-

ment. AND FURTHER SUBJECT TO ease-

ments, restrictions, and reservations of

record, if any.

EASEMENT AREA AND TOGETHER

WITH an easement as set forth in The

Memorandum of Easement dated October

28, 2010 over that part of the NE% of Sec 7

and part of the MW4 of Sec 8, all in Twp

134, Rng 35, described as follows: Com-

mencing at a found iron monument which

designates the Northeasterly corner of Lot 1,

Block 10 of the Original Townsite of Wade-

na; thence North 27 degrees 40 minutes 17

seconds East on an assumed bearing along

the Northwesterly line of First Street South-

east, for a distance of 462.01 feet to a found

iron monument on the Northeasterly line of

Aldrich Avenue; thence South 62 degrees 15

minutes 42 seconds East for a distance of

80.00 feet to the Southeasterly line of said

First Street Southeast; thence continuing

South 62 degrees 15 minutes 42 seconds

East along said Northeasterly line of Aldrich

Avenue for a distance of 67.72 feet to the

West line of said Sec 8; thence South 00 de-

grees 40 minutes 29 seconds East along the

West line of said Sec 8, also being the

Northeasterly line of Aldrich Avenue, for a

distance of 11.37 feet; thence South 62 de-

grees 15 minutes 42 seconds East continu-

ing along said Northeasterly line of Aldrich

Avenue for a distance of 226.88 feet to a

found iron monument; thence North 27 de-

grees 40 minutes 17 seconds East for a dis-

tance of 129.65 feet, said point is the point of

beginning of the land to be described; thence

North 62 degrees 18 minutes 20 seconds

West for a distance of 300.00 feet to the

Southeasterly line of said First Street South-

east; thence North 27 degrees 40 minutes

17 seconds East along the Southeasterly

line of said First Street Southeast for a dis-

tance of 31.58 feet; thence South 62 de-

grees 15 minutes 42 seconds East for a dis-

tance of 300.00 feet; thence South 27 de-

grees 40 minutes 17 seconds West for a dis-

tance of 31.35 feet to the point of beginning.

The above described tract contains 9,440

square feet.

SUBJECT TO easements, restrictions and

reservations of record, if any.

NOTICE IS FURTHER GIVEN that the ob-

ject of said action is to obtain a judgment de-

claring the Plaintiff is the owner in fee of the

property described above, subject only to the

interests of BNSF Railway Company in the

Easement and Easement Area portion of the

above-described property, and that the De-

fendants, and each of them, have no right, ti-

tle, estate, interest, or lien in or upon the said

real estate.

NOTICE IS FURTHER GIVEN that no per-

sonal claim is made by Plaintiff against any

of the Defendants.

Rule 114 of the General Rules of Practice for

the District Courts. Alternative Dispute Reso-

lution includes mediation, arbitration, and

other processes set forth in the rules. You
