APPEAL FOR A VARIANCE

Notice is hereby given that on Wednesday

the 17th day of June, 2009 at the hour of

8:00 p.m. in the Wadena County Courthouse

Auditorium, the Board of Adjustment will hold

a public hearing on the application of Steven

L. & Donna K. Roth for a variance on the

following described property: Southeast

Quarter (SE1/4), except the West 20 feet

thereof and except that part lying East of

U.S. Highway 71; except that part of the

Southeast Quarter of the Southeast Quarter

SE1/4 SE1/4) described as follows: begin-

ning at a point in the East line of said Section

Twenty-nine (29) which is also the center

line of U.S. Highway 71, which point is 454.5

feet North of the southeast corner of Section

Twenty-nine (29); thence westerly perpen-

dicular to the East line of Section Twenty-

nine (29), approximately 73 feet to the West

right-of-way line of U.S. Highway 71 and

continuing on the same bearing, 100 feet to

a point; thence northerly perpendicular to the

last mentioned line, 208.71 feet to a point;

thence perpendicular to the last mentioned

line, 100 feet to the West right-of-way line of

U.S. Highway 71 and continuing in the same

bearing approximately 73 feet to the center

line of U.S. Highway 71 and the East line of

Section Twenty-nine (29); thence southerly

with the East line of Section Twenty-nine

(29), 208.71 feet to the point of beginning

and containing 0.829 acres, more or less, to-

gether with an easement for the passage of

an irrigator over and across the South 280

feet of the East 80 feet of the Northeast

Quarter of the Southwest Quarter (NE1/4

SW1/4) and the North 280 feet of the East

80 feet of the Southeast Quarter of the

Southwest Quarter (SE1/4 SW1/4) and the

West 20 feet of the South 280 feet of the

Northwest Quarter of the Southeast Quarter

(NW1/4 SE1/4) and the North 280 feet of the

West 20 feet of the Southwest Quarter of the

Southeast Quarter (SW1/4 SE1/4), and an

easement 50 feet on either side of the cen-

terline of the existing drainage ditch as pres-

ently established over and across the East

Half of the Southwest Quarter (E1/2 SW1/4)

and West 20 feet of the Southeast Quarter

(SE1/4) for the exclusive purpose of repair-

ing and maintaining the existing drainage

ditch, all in Section 29, Township 134 North,

Range 35 West, Wadena Township, located

in an A-3 General Agriculture District.

Applicant proposes the second split of a

40-acre tract of land.

Access to the public hearing will be al-

lowed through the Sheriff's department on

the South side of the Courthouse only.
