Murder charge dropped, defendant released

DULUTH - A Duluth man held in the St. Louis County Jail since April on a murder charge has been released.

Prosecutors have dropped charges against 37-year-old Nakota Benjamin, one of two men accused of killing 28-year-old Joshua Olson at an apartment building in Duluth last April. Forty-one-year-old Joshua Littlewolf remains in jail on $400,000 bond. Littlewolf is charged with intentional second-degree murder and second-degree assault.

Prosecutor Nathaniel Stumme tells the Duluth News Tribune the initial investigation of Benjamin produced evidence that was impossible to ignore. Stumme says that as the investigation developed and scientific testing of evidence was completed, a dismissal of the charge was in the best interest of justice.

Benjamin called 911 after waking up and discovering Olson's body in his apartment on April 27.
